Los Angeles Premises Liability Attorney

Don’t Let A Serious Injury Ruin Your Future

Property owners and landlords are legally responsible for ensuring that the property is reasonably safe for visitors, residents, and employees. If an injury or accident occurs on someone else’s property due to negligent maintenance or a failure to warn others about hazards, the property owner can be held responsible through a premises liability claim. These accidents can result in severe injuries and financial burdens, including permanent disabilities such as brain damage, paralysis, amputation injuries, and other serious afflictions that significantly impact their lives.

If you suffered injuries or lost a loved one due to a property owner’s negligence in California, it’s essential to have a skilled attorney by your side. What Is Premises Liability?

Under California premise liability law, property owners must provide “ordinary care” in the management of their property. This means that property owners must keep their premises in reasonably safe conditions. In most cases, they must also warn visitors about hazards on the property they know about but cannot remedy. When a property owner fails this duty and the failure results in another party’s injuries, the property owner may be liable for the injured party’s damages.

The duty a property owner owes a party depends on the party’s classification. There are three classifications of visitors. They are:

  • Invitees—These are people invited to the property for business or commercial reasons, for example, restaurant or grocery store patrons. Property owners owe invitees the highest duty of care.
  • Licensees—These are people the property owner knows are on the property but did not expressly invite, for example, a mailman or neighbors.
  • Trespassers—With some exceptions (e.g., the trespasser was a minor and was drawn to the property by an attractive nuisance), the only duty a property owner owes trespassers is to refrain from causing willful or wanton injury or injury through gross negligence.

Once an injured party establishes that they belong to one of these three classes, they must prove that the property owner acted negligently and was thus responsible for their injuries.

What to Do After a Premises Accident

If you are harmed on another party’s property, it’s important that you take action as soon as possible to preserve your right to compensation. After a Premises Liability Accident, it is important to collect as much information as possible in order to build a strong personal injury claim. If possible, complete the following actions immediately after an accident occurs:

  • Call the Police, if Necessary: If you get hurt while on someone else’s property, you should let the owner and any other supervisors know right away. Involving the police is advantageous since they will create an official accident report. The accident report can be required in the future to demonstrate negligence.
  • Notify The Property Owner: You must notify the property owner of your accident and your injuries as soon as possible in order to initiate the claims process. You should file a written report with the property owner, manager, supervisor, etc., and ask for a copy of this report.
  • Collect Evidence: If you are able to at the time that your injury occurs, gather any relevant evidence at the scene. This includes pictures of the dangerous condition, names of any eyewitnesses, and a description of what you were doing when the accident occurred. The more evidence that you have, the easier your case will be to prove.
  • Obtain Witness Information: If you notice any witness nearby, you should ask for their consent to acquire their contact information. Witness testimonies can greatly support your personal injury claim.
  • Seek Medical Attention: If you fail to seek medical care immediately after your accident, you may have a hard time proving that any injuries you’ve suffered–and for which you are demanding compensation–are related to the accident on another’s property. Getting medical treatment not only improves your chances of a better recovery but also is a type of evidence that is invaluable in a premises liability claim.
  • Hire a Qualified Premises Liability Attorney: Working with a premises liability attorney can improve your chances of recovering the settlement amount that you deserve. As soon as you call Zakaryan Law Group and the team led by Robert Zakaryan, we will begin building your claim, working with interested parties, calculating your damages, and negotiating your settlement.

Potential Compensation for Premises Liability

Compensation in a premises liability case depends upon the particular case circumstances, the severity and type of injuries the victim suffered, and their overall prognosis for recovery. Although the amount of damages awarded in premises liability cases varies on a case-by-case basis, a typical damage award includes economic and non-economic damages.

Economic Damages are intended to compensate a victim for losses that have a determined dollar value. This includes lost wages, medical bills, loss of earning capacity, and property damage.

Economic damages may include but are not limited to the following:

  • Medical Bills
  • Lost Wages
  • Loss of Earning Capacity
  • Psychological Counseling
  • Physical and Cccupational Therapy

Non-economic Damages are monies intended to cover losses that are more subjective and not for billable damages. Non-economic damages include the following and more:

  • Pain And Suffering
  • Mental And Emotional Trauma
  • Loss Of Enjoyment Of Life
  • Loss Of Consortium

Punitive Damages: this is awarded in extremely rare cases in California. Punitive damages are meant to make an example out of the defendant, and are only awarded when the defendant has some type of malicious behavior towards the injured victim.

If the victim is killed due to the negligence of the property owner, the victim’s heir(s) will be given the legal right to file a wrongful death claim against the property owner. Available damages for a wrongful death claim include burial costs, funeral expenses, loss of consortium, and loss of financial support.

Statute of Limitations for a Premises Liability Claim

In California, the statute of limitations for personal injury and wrongful death claims after a Premises Liability accident is generally within two years from the initial date of the incident to file a claim for the injury you have sustained. If you exceed the deadline, you will no longer qualify to pursue legal actions against the other party for damages. However, California does have a few exceptions that may allow for an extension.

This includes the plaintiff being:

  • A Minor
  • Out-of-state
  • Incarcerated
  • Legally Insane
  • Incapacitated

Although there are some exceptions to the rule, typically, if you fail to file within two years, the court will refuse to hear your case, meaning your ability to recover will be lost. This is why it is important to speak to an experienced premises liability attorney right away to help protect your rights and assist you in obtaining the compensation you deserve.
